Terms of Service

These Terms of Service ("Terms") govern your use of the Verascribe Inc. website and the transcription services we provide. By requesting a quote or placing an order, you agree to these Terms on behalf of yourself and, where applicable, the firm or organisation you represent.

Our services

Verascribe provides transcription of audio and video recordings, including depositions, court hearings and other litigation support material. A transcript is a written record of what is audible on the recording you provide. We do not provide legal advice, and we do not act as an official court reporter unless that is expressly agreed in writing for a specific order.

Quotes and orders

Estimates shown on the website are based on the information you enter, including the length of the recording and the service options you select. An estimate becomes a confirmed quote only when we confirm it to you in writing after reviewing the recording. We may adjust a quote before work begins if the recording differs materially from what was described, for example in length, number of speakers or audio quality.

Pricing and payment

Services are charged per audio minute at the rate for the turnaround tier you select, plus any applicable surcharges, as shown on our pricing page at the time of your order. Scoping and proofreading for court reporters are quoted per job. Surcharges are set at the quote and are not added afterwards. Payment is by card, ACH or wire in US dollars, within the period stated on the invoice. We may require payment in advance for new clients or large orders.

Cancellation: no charge before a file is assigned; work completed to the point of cancellation is billed after assignment.

Turnaround

Turnaround times begin when you approve the confirmed quote. Approvals after 2:00 pm Eastern Time count from the next business day. Business days are Monday to Friday, Eastern Time, excluding US federal holidays. Files over four hours and multi-day proceedings are quoted with a specific delivery date. We make every reasonable effort to meet the turnaround you choose. If a recording's condition will prevent us from meeting it, we will tell you as early as possible.

Your responsibilities

You confirm that you have the right to provide the recordings you send us and to have them transcribed, including any consents required by law to record the participants. You are responsible for reviewing the transcript and for how it is used in any proceeding.

Confidentiality

We treat recordings, transcripts and case information as confidential. We use them only to perform the services you ordered, limit access to the people who need it, and will sign a matter-specific non-disclosure agreement on request. Our Privacy Policy and Security Practices describe how we protect this material.

Accuracy and corrections

Every transcript is produced by a legal specialist and checked by a second specialist against the audio before delivery, and is delivered with a note listing anything we could not resolve. Report anything within 14 days of delivery and we correct it at no charge; errors on our side are fixed the same business day. Passages that cannot be heard clearly on the recording are marked (indiscernible) with the time rather than guessed, and names that cannot be confirmed are marked (phonetic).

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses. Nothing in these Terms limits liability that cannot be limited by law.

Changes to these terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order.

Governing law

These Terms are governed by the laws of the jurisdiction in which Verascribe Inc. is incorporated, without regard to its conflict-of-laws rules.
